ElevenCreative Terms

These ElevenCreative Terms (“ElevenCreative Terms”) govern your (“you,” “your,” or “Customer”) use of ElevenCreative, including Dubbing under Exhibit 1, Studio under Exhibit 2, Ads Engine under Exhibit 3, Sound Effects under Exhibit 4, and Image & Video under Exhibit 5, each of which forms part of these ElevenCreative Terms and defines the offering it covers. Sections 1 through 6 apply to every use of ElevenCreative, and the applicable Exhibit applies in addition to them, whether you use an offering on its own or through another ElevenLabs Service. These ElevenCreative Terms supplement your written agreement with ElevenLabs or, if none exists, the ElevenLabs Terms of Service applicable to you (either, the “Underlying ElevenLabs Agreement”), which gives meaning to capitalized terms not defined here. Absent a signed written agreement, you accept these ElevenCreative Terms by using ElevenCreative.
1. ElevenCreative.
1.1. Service Description. “ElevenCreative” is the ElevenLabs platform for generating, editing, localizing, and managing creative content, including audio, images, video, and advertising assets. These ElevenCreative Terms cover the offerings defined in the Exhibits and the functions those offerings make available through the ElevenLabs dashboard, APIs, and other supported interfaces.
1.2. Model-Specific Terms. ElevenLabs may issue additional terms for a particular model, version, or configuration made available through ElevenCreative (“Model-Specific Terms”), which apply in addition to these ElevenCreative Terms as to the model they cover.
1.3. AI Model Providers. Certain ElevenCreative offerings, including Studio and Image & Video, are powered in whole or in part by third-party AI model providers (“AI Model Providers”). Your Input, and any Output generated from it, may be processed by those providers as necessary to deliver the applicable offering. A model an AI Model Provider provides is not a “Model” as defined in the Underlying ElevenLabs Agreement, and that agreement’s restrictions on use of the Services, including those on modification, derivative works, reverse engineering, and developing competing models, apply equally to the services and models of any AI Model Provider accessed through ElevenCreative. ElevenLabs identifies the AI Model Provider for each model in the Documentation or the Service interface. Where an AI Model Provider publishes its own terms or policies for its models or the resulting Output, they apply to your use, and you are responsible for reviewing and complying with them. ElevenLabs may add, remove, or replace an AI Model Provider, does not warrant any AI Model Provider or its models, terms, or policies, and, to the maximum extent permitted by law, is not liable for any of them or for that provider’s acts, omissions, outages, interruptions, delays, security incidents, or changes to or discontinuation of its models, terms, or policies. ElevenLabs’ indemnity for third-party intellectual property infringement does not extend to any AI Model Provider or its models, to Output generated using them, or to any other third-party model, asset, or content ElevenLabs identifies as such in the Documentation or the Service interface.
1.4. Availability. ElevenLabs may add, restrict, suspend, or withdraw any ElevenCreative offering, feature, model, or capability, and may apply usage limits. ElevenLabs may condition availability on your location, the location of individuals depicted in your Input, your industry or sector, your plan, your workspace configuration, or on acceptance of Model-Specific Terms, where reasonably necessary to address a legal, regulatory, or governmental requirement or risk or a third-party provider requirement, including where an AI Model Provider requires it or ceases to make a model available on the same terms. A change under this Section does not constitute a breach or a material degradation of the Services under the Underlying ElevenLabs Agreement.
2. Consents and Records. Where you submit Input containing the voice, image, or other visual likeness of an identifiable natural person, including reference media, you represent and warrant that you have given all notices and obtained all consents, releases, and authorizations required under applicable law, including biometric-data, right-of-publicity, and recording-consent laws, from that individual or any other person legally authorized to give them, in each case sufficient to permit ElevenLabs, its affiliates, subcontractors, and any AI Model Provider to process that Input and to generate, and you to use, the resulting Output. You shall retain records sufficient to demonstrate those consents for the longer of the period applicable law requires or five (5) years from the date obtained, and shall provide a copy of, or reasonable access to, those records on ElevenLabs’ reasonable written request where ElevenLabs requires them to respond to a claim, complaint, regulatory inquiry, or investigation relating to that individual or to meet a legal or regulatory requirement.
3. Your Responsibilities. You are responsible for determining whether an ElevenCreative offering, and any model it uses, is appropriate for your intended use. Rights in Output remain subject to the Underlying ElevenLabs Agreement and any applicable plan, Exhibit, or component or model terms under that agreement.
4. Community Sharing.
4.1. Scope. “Community Sharing” means the optional features through which Sound Effects or Image & Video Output may be made available in the applicable community library or gallery and accessed and used by other users. ElevenLabs does not make any Output available through Community Sharing unless you enable sharing or submit that Output using the controls ElevenLabs provides. Section 3 of Exhibit 4 governs how Sound Effects Output is selected and shared, and Section 2 of Exhibit 5 governs submission of Image & Video Output. An Output selected or submitted for sharing under the applicable Exhibit, and any accompanying prompt, title, tags, or other metadata, are the “Shared Materials.”
4.2. Rights in Shared Materials. You represent that you have all necessary rights to make Shared Materials available through Community Sharing and to grant the rights in this Section 4, including any consent required under Section 2 for an Output depicting an identifiable natural person to be made available to and used by other users. When an Output becomes Shared Materials, you grant ElevenLabs a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, adapt, display, distribute, and use them to operate and promote Community Sharing and the Services. Neither ElevenLabs nor another user owes you payment, royalty, or attribution for uses permitted by this Section 4 and the applicable Exhibit.
4.3. Rights of Other Users. When another user accesses or downloads Shared Materials, you grant that user a non-exclusive, worldwide, royalty-free license to use the Output, subject to that user’s Underlying ElevenLabs Agreement, the Prohibited Use Policy, and the applicable Exhibit. You receive a license on the same terms in respect of Shared Materials another user makes available and you access or download. For Sound Effects, each license permits only the uses allowed by Section 2 of Exhibit 4. ElevenLabs is not a party to a license granted under this Section 4.3 and has no liability arising from any other user’s use of Shared Materials. Browsing or previewing does not grant a continuing right to use an Output.
4.4. Disabling Sharing. You may disable Community Sharing at any time using the controls ElevenLabs provides. On disabling, ElevenLabs will stop sharing further Outputs and stop making your Shared Materials available to new users, as the applicable Exhibit provides. Licenses granted to other users before you disable sharing remain effective, and the license to ElevenLabs under Section 4.2 continues solely to the extent necessary to give effect to those licenses, administer them, or comply with law.
4.5. Removal and Availability. ElevenLabs may decline to publish, suspend, or remove Shared Materials at any time. Where ElevenLabs removes Shared Materials to address a legal, safety, security, or policy concern, it may also terminate licenses granted to other users. Community Sharing is available only where ElevenLabs makes it available for your account, plan, and workspace. Enterprise customers are not eligible for Community Sharing.
5. General. The licenses granted under Section 4 (Community Sharing) are enforceable solely between the users party to them and give no person any right, remedy, or claim against ElevenLabs. ElevenLabs may update these ElevenCreative Terms, including any Exhibit and any Model-Specific Terms, prospectively. An update that materially reduces your rights takes effect 30 days after ElevenLabs notifies you. An update required by law, or that ElevenLabs reasonably determines is necessary to address a legal, regulatory, safety, or security risk, takes effect immediately, and ElevenLabs will notify you of it promptly.
EXHIBIT 1: DUBBING
This Exhibit 1 applies to Dubbing, whether you use it on its own or through another ElevenCreative offering or ElevenLabs Service.
1. Service Description. “Dubbing” is the ElevenLabs Service that translates audio and video Input into other languages and returns dubbed Output in the voice of each detected speaker. Each dubbing model, version, or configuration ElevenLabs makes available, including every iteration within its version family, is a “Dubbing Model,” and references in this Exhibit 1 to Output are to Output generated using a Dubbing Model. Human-assisted dubbing delivered as a managed service is governed by the Productions Terms.
2. Dubbing v2. “Dubbing v2” is ElevenLabs’ end-to-end Dubbing Model. Unless expressly authorized in an Order Form or other written agreement executed by ElevenLabs, you shall not use, or permit any third party to use, Dubbing v2 Output in connection with: (a) feature films; (b) television programs or series, including scripted streaming productions; (c) content distributed on streaming, subscription, or video-on-demand platforms; (d) theatrical releases; or (e) other professional audiovisual entertainment productions intended for commercial distribution, in each case regardless of distribution channel and regardless of whether the Output is edited, re-recorded, or combined with other material. This restriction does not apply to: (i) content you create and publish directly to user-generated content platforms (for example, YouTube, TikTok, or Instagram); or (ii) advertising creative distributed on streaming or video-on-demand platforms as paid advertising placements only, not as programming.
EXHIBIT 2: STUDIO
This Exhibit 2 applies to Studio and the production workflows and automated features it makes available.
1. Description. “Studio” is the ElevenLabs Service that provides a production workflow for professional audio and video content, including a timeline-based editing interface, voice generation, sound effects, music, image and video generation, and automated and agentic features that draft, arrange, analyze, and place content on the timeline in response to your instructions.
EXHIBIT 3: ADS ENGINE
This Exhibit 3 applies to Ads Engine and the Advertising Platform integrations you enable through it.
1. Service Description. “Ads Engine” is the ElevenLabs service within ElevenCreative that enables you to connect supported Advertising Platforms, import advertising creatives and campaign information, generate localized or adapted creative assets, manage them through workflow templates and optional approval workflows, and, where supported, publish them back to those platforms. Supported platforms, and the functions available for each, are identified in the Service interface from time to time and may change or be discontinued.
2. Advertising Platform Integrations. You may connect third-party advertising platforms (each, an “Advertising Platform”). By connecting an Advertising Platform, you: (a) represent that you have authority to authorize access to the applicable account; (b) authorize ElevenLabs to access, retrieve, process, store, modify, transmit, and publish advertising data and creative assets at your direction, in each case only to the extent supported by the applicable Advertising Platform and Ads Engine; and (c) acknowledge that your use of any Advertising Platform remains subject to that platform’s own terms. As between you and ElevenLabs, each Advertising Platform acts under your agreement with it and is not a Subprocessor (as defined in the applicable data processing addendum) or a subcontractor of ElevenLabs.
3. Advertising Data. Advertising creatives, campaign data, performance data, and related advertising data you import or that ElevenLabs retrieves from a connected Advertising Platform at your direction (“Advertising Data”) is Input.
4. Output and Compliance. Without limiting Section 3.1 (Review), you shall review Output for translation and cultural accuracy. You are solely responsible for ensuring that your use of Ads Engine and Output complies with applicable law, including advertising and consumer-protection requirements, and with the terms of each connected Advertising Platform.
5. Third-Party Dependencies. Ads Engine depends on third-party Advertising Platforms and their APIs. ElevenLabs is not responsible for the acts or omissions of any Advertising Platform, for any change to or unavailability of an Advertising Platform or its APIs, for any account restriction a platform imposes, or for any asset or data once exported to an Advertising Platform at your direction. A change made by a third-party Advertising Platform does not constitute a breach or material degradation of the Services under the Underlying ElevenLabs Agreement.
EXHIBIT 4: SOUND EFFECTS
This Exhibit 4 applies to Sound Effects.
1. Service Description. “Sound Effects” is the ElevenLabs Service that generates sound effects audio from a text prompt. References in this Exhibit 4 to Output are to audio generated using Sound Effects, whether you generate it or lawfully obtain it through Community Sharing.
2. Use of Output. You may use, reproduce, modify, distribute, publicly perform, and display Output, including by incorporating it into films, trailers, advertising, video, games, applications, and other productions, subject to the Underlying ElevenLabs Agreement and the Prohibited Use Policy, and for commercial purposes only where your plan permits commercial use. You may exercise those rights only in respect of Output combined with other material, and you may not sell, resell, license, sublicense, distribute, or otherwise commercially exploit Output, or any part of it, on a standalone basis, or make Output available as isolated audio files or samples, or as part of any sound, sample, effects, or music library or other collection of sounds. Those restrictions do not apply to your making Output available through Community Sharing, or to the rights granted under Section 4 (Community Sharing) of these ElevenCreative Terms and Section 3 (Community Sharing) of this Exhibit 4, or to any other use ElevenLabs expressly permits in writing.
3. Community Sharing. Where ElevenLabs makes Community Sharing available for Sound Effects, you may use the controls it provides to enable or disable the sharing setting. When you enable sharing, ElevenLabs may select and share individual Outputs it considers suitable, for example based on user engagement, in the community sound effects library. Notwithstanding any broader license under the Underlying ElevenLabs Agreement, ElevenLabs will not make an Output available to other users through Community Sharing unless you have enabled sharing. Once you disable sharing, ElevenLabs will stop selecting new Outputs for sharing. Section 4 (Community Sharing) governs Shared Materials, the rights granted to ElevenLabs and other users, existing licenses, and removal.
EXHIBIT 5: IMAGE & VIDEO
This Exhibit 5 applies to Image & Video.
1. Description and Availability. “Image & Video” is the ElevenLabs offering that generates, edits, and transforms images and video, including text-to-image, text-to-video, image-to-video, editing, upscaling, and lip-sync, and that exports Output into other ElevenLabs Services. Where model-approval controls are available, your workspace administrator is responsible for selecting the models enabled for your workspace.
2. Sharing. You may submit individual Outputs using the controls ElevenLabs provides for possible inclusion in the community image and video gallery, and ElevenLabs will not make an Output available to other users through Community Sharing unless you submit it using those controls. Once you disable Community Sharing, ElevenLabs will stop making Shared Materials available to new users. Section 4 (Community Sharing) of these ElevenCreative Terms governs Shared Materials, the rights granted to ElevenLabs and other users, existing licenses, and removal. Generating a view link for an Output is not Community Sharing, and you are responsible for the persons with whom you share a link and for their use of the Output.
3. Custom Avatars. A “Custom Avatar” is a digital representation of a human or animated character generated from your Input, and the provisions of these ElevenCreative Terms that apply to Image & Video Output apply to it. Where a Custom Avatar depicts an identifiable natural person, Section 2.1 (Consents and Records) applies, and you may generate and use that Custom Avatar only as the consents obtained under that Section permit. You may delete a Custom Avatar using the controls ElevenLabs provides.
4. Stock Avatars. A “Stock Avatar” is a digital representation of a human or animated character ElevenLabs makes generally available through the Services. Subject to the Underlying ElevenLabs Agreement and these ElevenCreative Terms, ElevenLabs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Stock Avatars in connection with your use of the Services and in Output generated through the Services. Stock Avatars are provided “as is,” and you are responsible for determining whether your intended use is permitted. Without limiting the Prohibited Use Policy, you may not use a Stock Avatar in connection with political advertising or campaigning, adult or sexually explicit content, tobacco, firearms, gambling, or health claims, or in any manner suggesting that a real person endorses or has approved your content, product, or organization. ElevenLabs may modify, suspend, remove, or discontinue any Stock Avatar. You may not exploit a Stock Avatar on a standalone basis outside the Services.
