Reception by ElevenAgents Terms

These Reception by ElevenAgents Terms (“Reception Terms”) apply to your access to and use of Reception by ElevenAgents, a small and medium business (SMB) offering of ElevenAgents that may include trial access (the “Reception Offering”). These Reception Terms supplement the ElevenAgents Terms (“Agents Terms”) and the ElevenLabs Terms of Service (the “Terms of Service”).

In the event of any conflict between these Reception Terms and the Agents Terms or the Terms of Service, these Reception Terms will control with respect to your use of the Reception Offering.

By accessing or using the Reception Offering, including prior to creating an account, you agree to be bound by these Reception Terms.

1. RECEPTION OFFERING; TRIAL ACCESS. The Reception Offering is designed to enable rapid, self-serve access to ElevenAgents and may include limited trial functionality, temporary access to features, and restricted usage environments. Unless otherwise specified by ElevenLabs, your initial access to the Reception Offering may include a free trial period of up to 30 days (the “Trial Period”). During the Trial Period, access to certain features, usage limits, and functionality may be restricted or modified at ElevenLabs’ discretion. At the end of the Trial Period, your access to the Reception Offering may be suspended, limited, or terminated unless you upgrade to a paid plan or otherwise continue under terms made available by ElevenLabs. ElevenLabs may, in its sole discretion, modify, limit, suspend, or discontinue any aspect of the Reception Offering at any time, with or without notice, including during any trial period. The Reception Offering may differ from other ElevenAgents offerings in functionality, performance, availability, and support.

2. PHONE NUMBERS AND TELEPHONY FEATURES

A. Provision of Numbers. As part of the Reception Offering, ElevenLabs may assign or make available telephone numbers (“Platform Numbers”) to enable interaction with Customer AI Agents. Platform Numbers are provisioned through third-party telecommunications providers and remain under the control of ElevenLabs and/or its providers. ElevenLabs has no obligation to provision or maintain any Platform Number and may decline to assign numbers at its discretion.

B. Limited License; No Ownership. You receive a limited, revocable, non-exclusive, non-transferable right to use Platform Numbers solely in connection with the Reception Offering. You do not obtain any ownership, assignment, portability, or other proprietary rights in any Platform Number.

C. No Porting or Transfer. You may not port, transfer, assign, sell, lease, sublicense, or otherwise attempt to obtain control over any Platform Number.

D. Inbound-Only by Default. Unless expressly enabled by ElevenLabs, Platform Numbers may be used only for inbound communications. Any outbound calling or messaging functionality may be restricted, disabled, or subject to additional requirements.

E. No Guarantee of Continuity. Platform Numbers may be temporary, may be changed or reassigned, and may not persist across sessions, accounts, or subscription changes. ElevenLabs does not guarantee that any specific number will remain available to you.

F. Provider and Carrier Control. Platform Numbers and telephony functionality depend on third-party providers and carriers and may be subject to their requirements, limitations, and actions. ElevenLabs may change, suspend, reclaim, reassign, or remove any Platform Number at any time, with or without notice, including to comply with provider requirements, applicable law, or to mitigate fraud, abuse, or legal risk.

G. No Guarantee of Availability. ElevenLabs does not guarantee the availability, continuity, or performance of any Platform Number or telephony functionality. You acknowledge that telephony services involve third-party networks outside ElevenLabs’ control, and ElevenLabs is not responsible for call completion, routing, latency, or delivery of communications.

3. VERIFICATION AND COMPLIANCE.

A. ElevenLabs may require you to provide information or documentation at any time to verify your identity, business, intended use case, or compliance with applicable laws or provider requirements. Failure to provide requested information, or any indication of elevated risk (including fraud, abuse, or unlawful activity), may result in suspension or termination of your access to the Reception Offering or any associated telephony functionality. 

You are solely responsible for all use of any Platform Number assigned to you or your Customer AI Agent.

You must clearly and prominently disclose to callers that they are interacting with an AI system and not a human, where required by applicable law.

You are solely responsible for complying with all applicable laws, including Telecommunication Laws, privacy laws, and consumer protection laws, in connection with your use of the Reception Offering and for all communications initiated through the Reception Offering, including any required disclosures, consents, or opt-outs. 

B. Additional Data and Regulatory Restrictions.

  • No Sensitive Personal Data or PHI.
    You may not use the Reception Offering to collect, process, store, or transmit sensitive personal data that is subject to heightened regulatory requirements, including protected health information as defined by HIPAA, unless you have entered into a separate written agreement with ElevenLabs expressly permitting such use. The Reception Offering is not designed to meet HIPAA requirements, and ElevenLabs makes no representations or warranties regarding such compliance.
  • No Financial or Payment Data.
    You may not use the Reception Offering to collect, process, store, or transmit financial account information or payment card data (including credit or debit card numbers, bank account information, or authentication credentials), unless expressly authorized by ElevenLabs in writing. The Reception Offering is not designed to comply with payment card industry standards (including PCI-DSS), and ElevenLabs makes no representations or warranties regarding such compliance.
  • Call Recording and Consent.
    You are solely responsible for complying with all applicable laws relating to the recording, monitoring, storage, or analysis of communications, including obtaining any required notices and consents prior to recording or monitoring any call.
  • No Use by or for Children.
    You may not use the Reception Offering to knowingly collect, process, or store personal data from children under the age of 13 (or such higher age as required by applicable law), or to interact with children in a manner that would subject ElevenLabs to additional legal or regulatory obligations.

4. USAGE RESTRICTIONS AND ABUSE PREVENTION. Without limiting the Prohibited Use Policy or Agents Terms, you may not use the Reception Offering or any Platform Number for:

A. spam, unsolicited communications, or unlawful telemarketing;

B. scams, phishing, fraud, or deceptive practices;

C. impersonation, misleading caller identity, or unlawful caller ID or number spoofing;

D. harassment or abusive communications; or

E. any activity that violates applicable law or third-party provider requirements.

ElevenLabs may implement rate limits, usage caps, geographic restrictions, or feature limitations at any time to prevent abuse.

5. SUSPENSION AND TERMINATION. Without limiting any other rights under the Terms of Service or Agents Terms, ElevenLabs may suspend, restrict, or terminate your access to the Reception Offering, any Platform Number, or any telephony functionality:

A. at any time, with or without notice;

B. during any trial period; or

C. based on complaints, suspected abuse, provider action, or legal risk.

Upon suspension or termination, any assigned Platform Numbers may be reclaimed and made available to other users.

6. NO RELIANCE; NO EMERGENCY USE. The Reception Offering, including any telephony functionality, is provided on an “as is” and “as available” basis, without any guarantee of availability, continuity, routing, or performance. The Reception Offering is not intended for emergency services, emergency communications, or any use where failure, delay, or inaccuracy could result in harm.

7. RELATIONSHIP TO OTHER TERMS. These Reception Terms supplement and do not replace the Agents Terms or the Terms of Service. All provisions of the Agents Terms, including those relating to Telecommunication Laws, disclosures, consent, and indemnification, continue to apply.
