PLEASE READ THESE MODEL-SPECIFIC TERMS CAREFULLY.
The following Music Model-Specific Terms (“Model-Specific Terms”) supplement the Service Terms above and apply specifically to Customer’s use of the designated Version of a Music Model. For purposes of these Model-Specific Terms, “Version” means a defined release of a Music Model identified by a primary version number or identifier (e.g., “v1”), and includes all related updates, modifications, patches, and subversions within that version family (e.g., v1.1, v1.5, and any other v1.x iterations).
Unless expressly stated otherwise by ElevenLabs, all iterations within a given Version family shall be governed by the same Model-Specific Terms. ElevenLabs reserves the right to designate any subversion or update as a new Version that is subject to separate Model-Specific Terms.
1. Commercial Use.
A. In General. Commercial use of Outputs is permitted, subject to the restrictions set forth in these Service Terms.
B.Restrictions. Commercial use of Outputs is restricted as follows:
a. Free Plan. If Customer is on a Free Plan, Customer is prohibited from using Outputs for any commercial purpose. This includes a prohibition on the distribution of Outputs on streaming music platforms, including Spotify, Apple Music, Amazon Music, and Pandora.
b. Starter, Creator, Pro, Scale, or Business Plans. If Customer is on a Starter, Creator, Pro, Scale, or Business Plan, it is prohibited from using Outputs in the following commercial contexts:
i. offline (i.e., not on the internet or a mobile app) television or radio programs, films, other visual media, live broadcasts, or advertisements.
ii. high-traffic public events, including conferences, expos, or concerts;
iii. the creation of music libraries or repositories that include more than 25 Outputs, from which Customer licenses or otherwise distributes Outputs to third-parties; or
iv. in any context, Making Available (as defined in the OEM Terms) the Service or Output to any third-party for use in a manner that would violate this section or any other provision of these Service Terms.
c. Enterprise Plans. If Customer is on an Enterprise Plan, it is prohibited from using Outputs in the following commercial contexts:
i. the creation of music libraries or repositories that include more than 25 Outputs, from which Customer licenses or otherwise distributes Outputs to third-parties; or
ii. distribution on streaming music platforms, including Spotify, Apple Music, Amazon Music and Pandora.
2. Generation and Download Limitations.
A. Free Plan.
a. May generate up to 11 minutes of Output per month.
b. No downloads permitted.
B. Starter Plan.
a. May generate up to 30 minutes of Output per month.
b. May download up to 30 minutes of Output per month.
C. Creator, Pro, Scale and Business Plans.
a. Generation and download limits scale by plan type (see table below).
D. Enterprise Plan.
a. Custom generation and download limits agreed in writing.
E. Plan-Specific Usage Table. The following table outlines the usage limits and restrictions applicable to each Music subscription plan. These include monthly caps on audio generation and downloads, as well as restrictions on commercial use. Please review the conditions below before using Music under your selected plan.
