1. Definitions.

(a) “Entity” means any commercial, institutional, or organizational entity, such as a publisher, brand, platform, agency or studio.

(b) “Make Available” has the meaning set forth in the OEM Terms or the equivalent terms set forth in your Underlying ElevenLabs Agreement. 

(c) “Music Streaming Services” means platforms that distribute audio content via streaming technology, including Spotify, Apple Music, Amazon Music and Pandora.

(d) “Prohibited Commercial Contexts” means:

i. television programs, films, or other visual media;

ii. television or radio advertisements;

iii. live television or radio broadcasts;

iv. commercial video games; or

v. high-traffic public events, including conferences, expos, or concerts.

2. Subscription Plan-Based Use Restrictions. 

(a) Commercial Use.

i. If Customer is on the Free Plan, it agrees to use Outputs generated from Music solely for lawful, internal, personal, and non-commercial purposes. Commercial use is expressly prohibited on the Free Plan.

ii. If Customer is on any other plan (e.g., Starter, Creator, Pro, Scale, or Business), commercial use of Outputs is permitted, subject to these Service Terms and any applicable additional limitations.

  1. Plan-Specific Details.

(a) Free Plan.

i. May generate up to 11 minutes of Output per month.

ii. No downloads permitted.

iii. No commercial use, including no distribution of Output to Music Streaming Services.

(b) Starter Plan.

i. May generate up to 30 minutes of Output per month.

ii. May download up to 30 minutes of Output per month. 

iii. Commercial use permitted, other than:

  1. distribution of Output to Music Streaming Services;
  2. Making Available the Service or Output to any Entity, without limiting the OEM Terms; or
  3. use of the Services or Output in Prohibited Commercial Contexts.

(c) Creator, Pro, Scale and Business Plans.

i. Generation and download limits scale by plan type (see table below).

iii. Commercial use permitted, other than:

  1. Making Available the Service or Output to any Entity, without limiting the OEM Terms; or
  2. use of the Service or Output in Prohibited Commercial Contexts.

(d) Enterprise Plan.

i. Custom generation and download limits agreed in writing.

ii. Commercial use permitted, other than:

  1. distribution of Output to Music Streaming Services;
  2. use of the Service or Output in Prohibited Commercial Contexts other than as provided in the OEM Terms or the equivalent terms set forth in your Underlying ElevenLabs Agreement; or
  3. Making Available of Outputs other than as provided in the OEM Terms or the equivalent terms set forth in your Underlying ElevenLabs Agreement.

(e) Plan-Specific Usage Table. The following table outlines the usage limits and restrictions applicable to each Music subscription plan. These include monthly caps on audio generation and downloads, as well as restrictions on commercial use. Please review the conditions below before using Music under your selected plan.
