Ads Engine Terms

PLEASE READ THESE SERVICE-SPECIFIC TERMS CAREFULLY.
These Ads Engine Terms ("Service Terms") supplement your ("you", "your" or "Customer") existing agreement with ElevenLabs or, if no separate agreement exists, the ElevenLabs Terms of Service (either, the "Underlying ElevenLabs Agreement"). Your use of Ads Engine (defined below) is also subject to our Prohibited Use Policy and our Privacy Policy, where applicable. Defined terms used in these Service Terms have the meanings set forth in the Underlying ElevenLabs Agreement.
Please read these Service Terms carefully. By using Ads Engine, you agree to these Service Terms. If you do not agree or do not have the authority to agree, you are not permitted to use Ads Engine. These Service Terms constitute a legally binding contract between you and ElevenLabs. In case of any conflict between these Service Terms and other terms agreed upon between you and ElevenLabs, these Service Terms shall prevail with respect to your access or use of Ads Engine.
THESE SERVICE TERMS CONTAIN VARIOUS LIMITATIONS AND EXCLUSIONS OF LIABILITY IN SECTIONS 8, 9 AND 10.
1. ADS ENGINE SERVICES.
Ads Engine enables users to connect supported advertising platforms, import advertising creatives and related campaign information, generate localized or adapted creative assets, configure workflow templates, review assets through approval workflows, and export, upload, or publish assets to supported advertising platforms.
For clarity, Ads Engine is a creative workflow and asset management service. ElevenLabs does not operate advertising campaigns on your behalf.
2. ADVERTISING PLATFORM INTEGRATIONS.
You may connect third-party advertising platforms, including Google Ads, Meta Ads, and other supported services ("Advertising Platforms").
By connecting an Advertising Platform, you:
A. represent and warrant that you have the authority to access and authorize access to the applicable account;
B. authorize ElevenLabs to access, retrieve, process, store, modify, and transmit content, creative assets, campaign metadata, performance information, analytics and related advertising data available through the connected Advertising Platform as necessary to provide Ads Engine;
C. authorize ElevenLabs to create, update, upload, export, or publish creative assets to connected Advertising Platforms at your direction; and
D. acknowledge that your use of any Advertising Platform remains subject to the applicable third-party terms, policies, and requirements of that platform.
You are solely responsible for maintaining appropriate permissions for all connected Advertising Platform accounts.
3. ADVERTISING DATA.
Ads Engine may access and process advertising creatives, campaign information, audience information, performance metrics, engagement metrics, conversion metrics, and related advertising data ("Advertising Data").
Advertising Data constitutes Input under the Underlying ElevenLabs Agreement.
ElevenLabs may process Advertising Data solely as necessary to provide, maintain, secure, and improve Ads Engine, subject to the Underlying ElevenLabs Agreement, Privacy Policy, applicable Data Processing Addendum, and applicable law.
4. CREATIVE ASSETS AND RIGHTS.
You represent and warrant that you possess all rights, licenses, permissions, and consents necessary to:
A. upload, import, process, modify, adapt, localize, dub, translate, or otherwise create derivative works from Input submitted to Ads Engine;
B. use any voices, likenesses, images, trademarks, copyrighted works, advertising materials, or other content included in such Input; and
C. publish resulting Output in the jurisdictions where it is used.
You remain solely responsible for obtaining any required permissions from talent, creators, rights holders, advertisers, agencies, or other third parties.
5. LOCALIZATION AND ADAPTATION OUTPUTS.
Ads Engine may generate localized, adapted, translated, dubbed, reformatted, or otherwise modified creative assets ("Ads Engine Outputs"). Ads Engine Outputs constitutes Output under the Underlying ElevenLabs Agreement, subject to the following:
A. Ads Engine Outputs are provided on an automated basis and may contain errors, omissions, mistranslations, cultural inaccuracies, or other defects.
B. You are solely responsible for reviewing, validating, approving, and determining the suitability of all Ads Engine Outputs before use, publication, or distribution.
C. For clarity, Ads Engine localization functionality is governed exclusively by these Ads Engine Terms and not by any separate terms that may otherwise apply to translation-related services offered by ElevenLabs.
6. APPROVAL WORKFLOWS.
Ads Engine may provide approval workflows, review stages, permissions, or other governance features.
Such features are provided solely as workflow tools. ElevenLabs does not assume responsibility for reviewing, approving, rejecting, auditing, or validating creative assets, regardless of whether approval workflows are enabled.
7. TEMPLATES AND WORKFLOW CONFIGURATIONS.
Ads Engine may allow you to create templates, rules, configurations, and workflow settings ("Templates"). ElevenLabs retains ownership of the underlying software, workflow systems, models, and platform functionality used to generate and execute Templates.
8. COMPLIANCE RESPONSIBILITIES.
You are solely responsible for ensuring that all creative assets, Ads Engine Outputs, advertising claims, targeting decisions, and advertising campaigns comply with:
A. applicable laws and regulations;
B. consumer protection and advertising requirements;
C. industry-specific regulations;
D. intellectual property laws;
E. privacy and data protection laws; and
F. Advertising Platform policies and requirements.
ElevenLabs does not review Ads Engine Outputs for legal or regulatory compliance.
9. NO PERFORMANCE GUARANTEES.
Ads Engine is intended to assist with creative production and localization workflows.
ElevenLabs does not guarantee any advertising, marketing, business, financial, or commercial outcome, including impressions, clicks, engagement, conversions, return on ad spend, revenue, campaign performance; or market expansion results.
Past performance examples, benchmarks, case studies, demonstrations, or customer results are illustrative only and do not guarantee future results.
10. AVAILABILITY AND THIRD-PARTY DEPENDENCIES.
Ads Engine depends on third-party Advertising Platforms and related APIs.
ElevenLabs does not control and is not responsible for:
A. changes to third-party APIs;
B. account suspensions or restrictions imposed by Advertising Platforms;
C. platform outages or downtime;
D. changes to platform functionality; or
E. removal of integrations by third parties.
Features may be modified, limited, or discontinued if required by a third-party Advertising Platform.
