11.ai Terms

These 11.ai Terms (“Terms”) supplement your (“you”, “your”, or “Customer”) existing agreement with ElevenLabs, or if no separate agreement exists, the ElevenLabs Terms of Service (either, the “Underlying ElevenLabs Agreement”). Your use of ElevenLabs’ MCP (defined below) functionality, 11.ai, is subject to such Underlying ElevenLabs Agreement (including the Prohibited Use Policy and Privacy Policy) and these Terms, provided in the event of a conflict, these Terms shall prevail as it relates to your use of the MCP. Capitalized terms used but not otherwise defined herein have the meanings set forth in the Underlying ElevenLabs Agreement.
Please read these Terms carefully. If you do not agree to these terms or do not have the authority to accept them, you may not use the MCP functionality. These terms are a legally binding contract between you and ElevenLabs.
THESE TERMS CONTAIN: (I) VARIOUS DISCLAIMERS IN SECTION 2; AND (II) VARIOUS LIMITATIONS AND EXCLUSIONS OF LIABILITY IN SECTION 5.
1. unknown nodeModel Context Protocol within Conversational AI
1.1unknown node“MCP” is an open protocol that standardizes how applications provide context to LLMs, and for purposes of these Terms, refers to the functionality within the ElevenLabs Conversational AI Service whereby you may connect a custom MCP server to allow for integrations with the Services.
1.2unknown nodeCustomer’s use of the Conversational AI Service shall remain subject to the Conversational AI Terms incorporated in the Underlying ElevenLabs Agreement. These Terms shall be deemed a supplement thereto. To the extent there is a conflict between these Terms and the Conversational AI Terms, the Terms shall prevail only as it relates to the provision or use of the MCP functionality. Nothing in these MCP Terms is intended to relieve you from your obligations or liabilities set forth in the Underlying ElevenLabs Agreement or Conversational AI Terms.
2. Disclaimers.
2.1 unknown nodeBy accepting these Terms or accessing or using the MCP functionality, you understand, acknowledge, and agree that the MCP functionality as described above: (a) may contain defects, bugs, or other issues and may not operate as intended; and (b) is being provided solely on an “AS IS” and “AS AVAILABLE” basis without any warranty of any kind, and may be modified or discontinued in our sole discretion.
2.2unknown nodeWithout limiting the additional disclaimers set forth herein, you acknowledge that by using the MCP, you will be authorizing the Services to take actions on your behalf, including with respect to data processing, software manipulation, and system interactions, and you are fully responsible for all such actions and should exercise caution in determining whether to grant such authorization, and ElevenLabs expressly disclaims any liability for content, data, or information that is obtained by the user through the MCP client.
2.3 unknown nodeYOU ASSUME ALL RISKS AND COSTS ASSOCIATED WITH YOUR USE OF THE MCP FUNCTIONALITY, INCLUDING WITHOUT LIMITATION ANY DAMAGE TO OR LOSS OF ANY EQUIPMENT, SOFTWARE, INFORMATION, OR DATA (INCLUDING PERSONAL DATA). WITHOUT LIMITING THE FOREGOING, YOU ARE SOLELY RESPONSIBLE FOR YOUR ELECTION TO CARRY OUT INTEGRATIONS WITH THE SERVICES, INCLUDING YOUR SELECTION OF ANY MCP SERVER OR DATA SOURCE. TO THE EXTENT PERMITTED BY APPLICABLE LAW, ELEVENLABS MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, AND EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, PERFORMANCE, AND FITNESS FOR A PARTICULAR PURPOSE. ELEVENLABS MAKES NO WARRANTY THAT THE MCP FUNCTIONALITY WILL MEET YOUR REQUIREMENTS OR THAT SUCH FUNCTIONALITY WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE, NOR DOES ELEVENLABS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE MCP FUNCTIONALITY, OR THE COMPLETENESS OR ACCURACY OF ANY OUTPUT OBTAINED THROUGH, OR ACTION PERFORMED BY, THE MCP. THE MCP AND ITS USE MAY RESULT IN LOSS OF OR MODIFICATION TO EQUIPMENT, SOFTWARE, INFORMATION, OR DATA (INCLUDING PERSONAL DATA), OR OTHER UNPREDICTABLE DAMAGE OR LOSS TO YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES AND CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
2.4 unknown nodeWe are not obligated to provide any maintenance, technical, or other support for the MCP functionality.
2.5unknown nodeTo the extent the MCP functionality is designated as alpha, beta, pilot, preview, or a similar designation (“Beta Services”), the Beta Services Addendum incorporated in the ElevenLabs Terms of Service shall apply, provided to the extent there is a conflict between such Beta Services Addendum and these MCP Terms as it relates to the MCP functionality, these Terms shall prevail.
2.6unknown nodeWe may, at any time, suspend or disable your use of the MCP, in whole or in part, if it violates these Terms or if we determine that we need to do so to protect the security, integrity, or proper functioning of the Services or to prevent harm to our users or the public.
3. unknown nodeLimited License and Restrictions.
3.1unknown nodeYou agree not to (and not to permit any third party to) use the MCP functionality for any purpose (or to facilitate any purpose) that is prohibited under these Terms or the Underlying ElevenLabs Agreement (including the Prohibited Use Policy, which for clarity, shall apply to your access and use of the MCP). You agree not to (and agree not to permit any third party to), except to the extent permitted by applicable law and subject to Section 3.2 below, modify, distribute, prepare derivative works of, reverse engineer, reverse assemble, disassemble, reverse compile, decompile, engage in model extraction or stealing attacks, or otherwise attempt to decipher any code in connection with the MCP or any other aspect of the Services.
3.2unknown nodeYou acknowledge that the MCP functionality leverages material open sourced by a third party. Nothing in these Terms is intended to limit any rights you may have under, or grant you rights that supersede, the terms of such open source license.
4. unknown nodeFeedback and Contact From ElevenLabs. Your Feedback is critical to the development and improvement of the MCP functionality. You agree to provide timely Feedback on the MCP as requested by ElevenLabs. All Feedback provided by you shall be the property of ElevenLabs, and ElevenLabs shall have the right to use such Feedback for any purpose without any compensation to you. You waive any moral and similar rights relating to Feedback that you may have under any applicable law.

5.1unknown nodeNOTWITHSTANDING (AND IN FURTHER LIMITATION OF) THE LIMITATIONS ON LIABILITY SET FORTH IN THE UNDERLYING ELEVENLABS AGREEMENT, ELEVENLABS’ MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE MCP FUNCTIONALITY IS LIMITED TO ONE HUNDRED DOLLARS ($100.00).
5.2unknown nodeTo the fullest extent permitted by applicable law, you will indemnify, defend (at our option), and hold harmless ElevenLabs and our officers, directors, agents, partners, licensors, employees and agents from and against any Claims arising out of or related to (i) your access to or use of the MCP; (ii) your Content or Feedback obtained in connection with your use of the MCP; (iii) your breach of these Terms; (iv) your use of the MCP (or you permitting a third party to use the MCP) in violation of applicable laws, rules, regulations, or our Prohibited Use Policy; (v) your violation, misappropriation, or infringement of any rights of another (including intellectual property rights or privacy rights); or (vi) your conduct in connection with the MCP.

6.1 unknown nodeFor clarity, by providing data, information, or material to ElevenLabs through your access or use of the MCP functionality, you acknowledge such data, information, and material, as well as any output generated in connection with your use of the MCP, constitutes Content or Customer Content, as applicable, for purposes of the Underlying ElevenLabs Agreement, and such data, information, and material may be used by ElevenLabs as provided in the Underlying ElevenLabs Agreement, including to provide, maintain, and improve the MCP functionality within the Services (to the extent permitted within the Underlying ElevenLabs Agreement), comply with applicable law, enforce the Underlying ElevenLabs Agreement and these terms, and keep the Services safe and secure.
6.2unknown nodeYou represent, warrant, and covenant that: (i) your use of the MCP will be in compliance with all applicable laws, rules and regulations, including all applicable privacy laws and regulations; (ii) you have the necessary rights, licenses, and consents to authorize the integrations you enable with the MCP servers (and allow access to relevant data sources, services, systems, and technology) selected through the MCP functionality and to allow for ElevenLabs to transmit and/or receive data from such third-parties as contemplated by these Terms; and (iii) to the extent ElevenLabs receives any information or material from any MCP server and/or data source or otherwise in connection with the use of the MCP, Customer has all rights, licenses, and consents (including privacy consent where required by applicable law) necessary to allow ElevenLabs to use, distribute, and otherwise process such data, information, or materials as contemplated by these terms and the Underlying ElevenLabs Agreement.
7. Miscellaneous.
7.1unknown nodeThese Terms commence on the date you indicate your acceptance to these Terms or enable or use the MCP, whichever is earlier, and will continue for so long as the Underlying ElevenLabs Agreement remains in effect unless earlier terminated by ElevenLabs.
7.2unknown nodeElevenLabs reserves the right to modify or terminate the MCP or your use thereof, or to limit or deny access to the MCP, at any time, in our sole discretion, for any reason, without any liability or additional notice to you.
7.3unknown nodeTo the extent the MCP constitutes a Beta Service, you acknowledge and agree that ElevenLabs may never make the MCP generally available as part of, or an add-on to, the Services, and that your decision to purchase or use the Services was not and is not contingent on the delivery of the MCP functionality or any functionality relating thereto.
7.4unknown nodeYou are responsible for the privacy, security, and integrity of your API and any Plugin Requests that you receive. You will maintain at least reasonable and appropriate organizational, administrative, physical, and technical security measures to keep your API and Plugin Requests secure. If you discover any vulnerabilities or breaches related to your API or a Plugin Request, you must promptly contact us and provide details of the vulnerability or breach.
7.5unknown nodeElevenLabs reserves the right to modify or terminate these Terms at any time. Any changes will be posted on the ElevenLabs’ website or communicated to you through other means. Your continued use of the MCP functionality after such changes constitutes your acceptance of the new MCP Terms.
